1. Acceptance of Terms

By accessing or using Transmit ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Transmit is an email infrastructure platform that enables sending, receiving, and managing emails. By default, Transmit provides a managed infrastructure (Managed Mode) where we handle email delivery. Alternatively, you may choose to integrate with your own AWS Simple Email Service (SES) account (BYOK Mode).

3. Your Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • If using BYOK Mode, ensuring your AWS SES account is in good standing and managing associated costs
  • Complying with all applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Confirming all recipient lists are 100% opt-in before sending
  • Verifying domain ownership before enabling email sending
  • Maintaining accurate suppression lists

4. Prohibited Uses

You may not use the Service to:

  • Send spam or unsolicited bulk email
  • Use purchased, rented, or scraped email lists
  • Send to recipients who have not explicitly opted in
  • Send phishing emails or malware
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems

5. Email Delivery and AWS Integration

In Managed Mode, Transmit handles the underlying email infrastructure and associated delivery costs within your plan limits. In BYOK Mode, the Service connects to your own AWS SES account; in this case, you are responsible for maintaining your AWS account and any costs charged by Amazon. AWS's terms of service apply to your use of SES in both scenarios where applicable.

6. Payment Terms

Paid plans are billed monthly or annually as selected. Payments are non-refundable except as required by law. We may change pricing with 30 days notice.

7. Intellectual Property

The Service, including its software, design, and content, is the property of Transmit and is protected by intellectual property laws. You retain ownership of your data and content. By using the Service, you grant us a license to process your data as necessary to provide the Service.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

We may suspend or terminate your account for violations of these terms. You may cancel your account at any time. Upon termination, your data will be deleted according to our data retention policy.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
